Monday, May 29 - Update on Plans for Addressing the RV Parkat Etowah Valley Golf and Resort

Residents of Etowah, We continue to work on our concerns about the planned RV park on the Etowah Valley Golf Course. Here is a brief summary of recent accomplishments, the Zoning Board of Adjustment (ZBA) meeting, and other information we have obtained. 1. We engaged Robert Deutsch & Tikkun Gottschalk, Attorneys, to represent us before the Zoning Board of Adjustment (ZBA). https://dglawpa.com/ 2. We met with the County Attorney, Charles Russel Burrell, on Thursday, to learn more about the Zoning Board Review Process. 3. The ZBA will be meeting on Wednesday, May 31st, 2023 at 4PM, in the King Street Meeting Room at 100 N King Street in Hendersonville. We have been asked by our Attorney to provide them with a list of people who can justify reasons for standing, and who would be willing to speak in opposition to the potential RV Park before the Zoning Board of Adjustment (ZBA). Not everyone will actually be entitled to standing, but our Attorney wants as many people as possible arguing for standing. Your chances of being granted standing will be greater if you can demonstrate a unique reason. What is meant by Legal Standing? ” Standing limits participation in lawsuits and asks whether the person(s) bringing a lawsuit, or defending one, has enough cause to “stand” before the court and advocate, since not anyone can go to court for any reason. To have standing, a party must show an “injury in fact” to their own legal interests.” If you wish to be considered for standing, please click on the link below and provide us with the following information as soon as possible: Name; Reason for Legal Standing; Address; Phone Number; and Email Address. The Developer - Tribute Investment & Development, Inc. - is requesting a Special Use Permit for the Etowah Valley Golf Course to create an RV Park. This use is allowed within the R1 Zoning District, but it requires a Special Use Permit. The Board of Commissioners chose to make some uses permitted by right and others requiring a Special Use Permit. All Special Use Permits go before the ZBA. The following was provided by the Henderson County Code Services Director & Zoning Administrator: “Special Use. Uses that are generally compatible with land uses permitted in a general district, however, because of their unique characteristics or potential impacts on the surrounding neighborhood and/or the County as a whole, require individual consideration of their location, design, configuration and/or operation at the particular location proposed. A special use must meet both the specific standards for the use as well as the general standards for the issuance of Special Use Permits. We will soon be distributing flyers to homes near the Etowah Valley Golf Course. We sent out emails to folks who offered to help on Facebook and Nextdoor.
