We continue to navigate the many administrative tasks required to prepare for the June 28th Zoning Board of Adjustment (ZBA). We have been sharing information with our attorneys, and we have lined up our experts who will testify on our behalf at this meeting.
The Henderson County Code Services Director & Zoning Administrator provided us with the following information about how you can participate at the meeting:
Any person who wishes to speak during the process will need to sign up at the beginning of the meeting. There will be a signup sheet before you walk into the auditorium where a staff member from Henderson County will sit at. Anyone, if they have standing or not, will have the opportunity to speak after all of the evidence has been gathered and the parties have no more evidence they wish to submit for their respective cases. The individuals who sign up and wish to speak during this time do not need to have anything to submit to the ZBA, since they were not identified at the beginning of the hearing to have standing. This is just a public comment period where people can speak their minds.
If someone wishes to become party to this case, they will have the opportunity to do so at the beginning of the meeting before the hearing starts. The Chair to the ZBA will ask for anyone who wishes to be party to this case to come to the front and present why they should have standing. Ultimately, the ZBA will decide whether to grant standing or not. The applicant’s attorney has the ability to challenge someone’s request to prove standing. If the ZBA decides to grant standing to other individuals, they will have the opportunity to submit evidence and cross-examine any witnesses giving testimony. Additionally, if they are found to have standing the evidence they provide must be from an expert in the field they are submitting evidence on. Physical copies of the evidence they wish to submit will be required. I would suggest at least 10 copies, but more would be preferable. The expert who prepared the evidence must be in attendance to present their findings and for all other parties to cross-examine. The individuals who become party to this case will be required to attend all the meetings.

We thank all of you who have donated to the Etowah Valley Preservation Society. So far, you all have donated over $55,000 dollars. To give you some idea of where your money is going; by the end of the week, we will have used $17,000 to fund retainer fees for attorneys, and another $20,000 to fund retainer fees for our experts, most of whom must travel to attend the ZBA meetings.
Our fundraising committee has been busy brainstorming more ways to raise funds for this effort. Recall our goal is to raise $100,000. Just to give you an idea of some of the things coming up soon: we are working with a local restaurant to sell take-out barbeque; we will be having more exciting raffles; and we are planning a silent auction with items from local artists, services, and products.

*MARK YOUR CALENDAR TO ATTEND THE ZBA MEETING ON JUNE 28TH AT 4 PM AT BLUE RIDGE COMMUNITY COLLEGE. THE AUDITORIUM HOLDS 450 PEOPLE, SO WE NEED EVERYONE WITH EVEN THE SLIGHTEST CONCERN TO ATTEND. ADDITIONAL DETAILS SUCH AS DIRECTIONS WILL BE PROVIDED SOON.
