July 9th UPDATE

Residents of Etowah,

Here is a summary of activities that have occurred over the last couple of weeks.

Our attorney at Deutsch & Gottschalk, PA, submitted an updated complaint to the Court adding an additional complainant and revising some wording. Recall the legal complaint with the North Carolina Superior Court stated that the Etowah Valley Golf Course legally must remain a golf course, is a valuable amenity to the neighboring communities, and the conversion of it to an RV park will cause substantial harm to all of us.

Our attorney has shared with the Developer’s attorney documentation obtained from Henderson County’s Register of Deeds justifying the complaint. Our attorney is currently awaiting a response from the Developer’s attorney.

Zoning Board of Adjustment (ZBA) Meetings

The next ZBA meeting is scheduled for July 19th at 4:00 PM at Blue Ridge Community College. The agenda for this meeting is posted on the Henderson County website.

Both the above website and our Preserve Etowah Valley website will carry the latest information for the ZBA meeting.

IT IS IMPORTANT THAT YOU MONITOR THESE SITES FREQUENTLY BECAUSE THE SCHEDULE CAN CHANGE

Standing

On Thursday, June 29th, we held a Zoom meeting with our attorney at Brough Law Firm in Chapel Hill. The topic of this meeting was “how does one go about obtaining standing before the ZBA.”

Standing means you want to be a “party” to the hearing. You would be able to ask questions of the Developer, their attorney, and their experts. You could also be asked questions by the developer’s attorney.

From the responses we have received, many of you claim you will be damaged for similar reasons. If the ZBA deems your reasons are like those of someone else or the greater community, you may not be given standing, and you may not even be allowed time to state your full case.

Because of this, we are suggesting that neighborhoods (e.g., Greenwood Forest, The Greens, The Golf Villas etc.) band together, seek a spokesperson, and draft a strong reason(s) as to why your group feels you, as individuals, will be damaged if the proposed RV Park and Sewage Treatment Plant is approved. We believe that a “group effort” such as this will increase the likelihood that more members of the community will be given standing. The hope is that each neighborhood/group will come up with unique and strong reasons you should have “standing.”

Members of the Etowah Valley Preservation Society steering group will be working with neighborhood teams this coming week as they prepare their justification for standing.

This said, individuals can still request standing on their own. For additional information, e-mail PreserveEtowahValley@gmail.com for how to go about requesting standing.

PLEASE NOTE: Due to the overwhelming popularity of the BBQ Take-Out Event and the limited amount of parking available at The Salty Landing, we have decided to move the Blind Auction from this venue to another local location, date and time. More details on the Blind Auction will be forthcoming.
